Reformed by the points-based system introduced in the 2024 regulations and operational alongside the Trusted Employer Scheme. A points threshold must now be met in addition to appearing on the critical skills list.

Rarely the right answer for a UHNW principal, but frequently the right answer for the family office team, the CIO or the executives being relocated alongside them — and section 27(b) permanent residence on day one of a critical skills visa is one of the fastest routes to permanent status anywhere.

What can go wrong
  • You must both appear on the critical skills list and clear the points threshold — the 2024 reform added a hurdle, it did not remove one.
  • Professional body registration and SAQA evaluation of foreign qualifications are mandatory and slow, often adding 3-6 months before the visa file can even be lodged.
  • The critical skills list is revised periodically and occupations have been removed with no transitional protection.
  • Losing the job can end the visa and, with it, the derivative status of the whole family.
  • Full tax residence follows employment here — worldwide income at up to 45%, with the section 10(1)(o)(ii) foreign employment exemption capped at ZAR 1.25m and unlikely to help someone actually working in South Africa.
